1.Background and context
The Danish Refugee Council (DRC) has been providing Relief, Humanitarian and Early recovery/development assistance in the Horn of Africa since 1997. Using a protection of human rights framework, DRC has mainly focused on Somalis who are displaced by conflict
The DRC Somalia Program is the largest of the six country programs in the Horn of Africa and Yemen region. DRC is among the INGOs with the largest presence in Somalia, with country-wide programs implemented through six main sub offices in Puntland and Puntland in the north and in Hiraan Region, Gedo Region, Bay Region and Banadir Region in South and Central Somali. Programs include protection, food security and livelihoods, water and sanitation, food and NFI distribution, community driven recovery and development and advocacy, amongst others.
Danish Demining Group (DDG) has operated in South Central Somalia since 2007 and in Somaliland since 1999 clearing mines and other explosive remnants of war. DDG’s approach has since evolved to support community and district-level planning that addresses an array of public safety concerns whether related to firearms, explosive remnants of war, and local conflict.
DDG is a unit within Danish Refugee Council (DRC). DRC is an independent, non-profit organization (NGO), founded on the basis of humanitarian principles, and human rights based approach, to secure the protection of refugees and internally displaced persons (IDPs), and to promoting long term solutions to the problems of displacement.
2.Purpose
The need for this local consultant is to identify where changes and updating is required on the current DRC/DDG HR Policy in terms of Labor laws and Annexes in place.
- Legal review and certification on DRC/DDG Human Resource Policy Manual and Annexes.
- Ensure DRC/DDG Human Resource Policy Manual and Annexes are in compliant to the relevant local labour laws of Somaliland, Puntland and South Central Somalia.
- Provision of legal recommendations on areas where DRC/DDG Human Resource Policy and Puntland, Somaliland and South Central labour law have contradictions;
- Provision of full analysis report signed and stamped by “the consultant”
3.Key Responsibilities
3.1.Scope of consultancy.
· Legal review and certification on DRC/DDG Human Resource Policy Manual and Annexes.
· Ensure DRC/DDG Human Resource Policy Manual and Annexes are in compliant to the relevant local labour laws of Somaliland, Puntland and South Central Somalia.
3.2.Methodology
Given the background and scope of the assignment, the successful consultant would define appropriate methodologies in legal analysis and review as well as providing recommendations and full analysis report which address the key components and contradictions for this review with the use of existing labour laws as part of updating on existing/current information.
3.3.Key deliverables/outputs
This must be completed and delivered to DRC/DDG on time with quality standards (including key findings, challenges and recommendations)
An inception report detailing an in-depth understanding of the TOR, highlighting how the assignment will be undertaken, including the use of methodologies and proposed tools.
4.DRC/DDG’s responsibilities
DRC will provide the following:
a) All available documents and contacts as requested by the consultant;
b) Guide the consultant on the important stakeholders and area
c) Consultancy fees at a mutually agreed rate.
Reporting Arrangements
The consultant shall work under the direct supervision of DRC/DDG Somalia HR/Admin Manager.
5.DURATION OF ASSIGNMENT
It is anticipated that the exercise will take about 4 weeks from 1st November 2016.
6.EXPECTED PROFILE OF CONSULTANT
· University degree in Human Resources, Public Administration, Law or Social or Political Sciences. Degree in Human Resources or Law would be an advantage.
· At least 5 years of relevant experience in Human Resources or Law; including at least two years of experience working with INGOs system
· Proven experience in labor laws assessment carried out is an added advantage
· Valid license of professional lawyer practitioner and/or law firm
· A demonstrated understanding and analytical capacity in the identification of issues relating to contradictions and differences of Human Resource Policies
· Excellent report writing skills and ability to meet deadlines
· Familiar with current Somalia labor laws, Puntland, Somaliland and South-central
· Excellent written and communication skills in English.
7.TERMS & CONDITIONS This assignment will be carried out in PL, SL and South Central and open to Somali Nationals only. The consultant must have knowledge of the context and Security situation in all the three regions and have ability to work independently. DRC will not be responsible for any insurance cover for the consultant.
8. General
Commitments: DRC/DDG has a Humanitarian Accountability Framework, outlining its global accountability committments. All staff are required to contribute to the achievement of this framework

The Consultant must share following documents:
i. A suitability statement including CV of participating consultant (s) with details of qualifications and experience, telephone number and names of three referees,
ii. Technical proposal that summarizes understanding of the TOR, and the proposed methodology including the foreseen work plan for the activity schedule; and
iii. Financial proposal providing cost estimates and consultancy fees in US dollars ($). Consultancy rate is negotiable.
